1. Acceptance of Terms

By accessing or using Score A Kick ("the Service"), operated by Score A Kick ("we", "us", "our"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you must not use the Service. We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

Score A Kick is a sports analytics platform that provides AI-powered player performance scores, match outcome probabilities, and related statistical insights for the English Premier League. The Service is offered through a website with both free and paid subscription tiers.

3. No Gambling, Betting, or Financial Advice

The Service does not constitute gambling, betting, fantasy sports wagering, or financial advice of any kind. All predictions, scores, probabilities, and analytics provided are for informational and entertainment purposes only. We do not facilitate, encourage, or endorse wagering, gambling, or any form of financial risk-taking based on our content.

You acknowledge and agree that any decisions you make based on our predictions or analytics are entirely your own responsibility. We expressly disclaim any and all liability for any losses, damages, or negative outcomes arising from your use of or reliance on the information provided by the Service.

4. No Guarantee of Accuracy

Predictions and analytics are generated by statistical models and algorithms. We make no representations, warranties, or guarantees whatsoever as to the accuracy, completeness, timeliness, or reliability of any prediction, score, probability, or other information provided through the Service. Past performance of our models does not guarantee future results. Sports outcomes are inherently unpredictable, and our analytics are probabilistic estimates, not certainties.

5. User Accounts

To access certain features, you must register for an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for any reason including violation of these terms.

6. Subscriptions and Payments

Paid subscriptions ("Pro") are billed on a recurring monthly basis through Dodo Payments. By subscribing, you authorize us to charge your payment method on each billing cycle. Prices are subject to change with reasonable notice. You may cancel your subscription at any time through the account management portal; cancellation takes effect at the end of the current billing period.

No Refund Policy: All subscription payments are final and non-refundable. Once a payment is processed, no refunds, credits, or pro-rata adjustments will be issued for any reason, including but not limited to dissatisfaction with predictions, partial use of a billing period, early cancellation, or failure to use the Service. By subscribing, you acknowledge and accept this no-refund policy. Cancellation stops future billing but does not entitle you to a refund of any prior payment. Refunds may only be issued where strictly required by applicable consumer protection law.

7. Intellectual Property

All content, data, algorithms, models, designs, logos, and trademarks on the Service are owned by or licensed to Score A Kick and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Service without our prior written consent.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated tools to extract data from the Service
• Resell, redistribute, or commercially exploit Service content without authorization
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
• Circumvent any access restrictions, authentication mechanisms, or paywall controls
• Create multiple accounts to abuse free-tier limitations
• Impersonate any person or entity, or misrepresent your affiliation

9. Third-Party Services and Data

The Service uses data from third-party sources including football-data.org and processes payments through Dodo Payments. We are not responsible for the accuracy of third-party data or the availability, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCORE A KICK AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT OF THE SINGLE MOST RECENT SUBSCRIPTION PAYMENT YOU MADE IN THE BILLING PERIOD DURING WHICH THE EVENT GIVING RISE TO THE CLAIM OCCURRED. FOR FREE-TIER USERS OR USERS WITHOUT AN ACTIVE PAID SUBSCRIPTION AT THE TIME OF THE CLAIM, OUR MAXIMUM LIABILITY SHALL BE ZERO.

12. Indemnification

You agree to indemnify, defend, and hold harmless Score A Kick and its owners, operators, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Not Affiliated with the Premier League

Score A Kick is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the Premier League, the English Football Association, or any of their clubs, players, or representatives. All team names, logos, and related marks are trademarks of their respective owners and are used for identification purposes only.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of an established arbitration body, with the arbitration taking place in a mutually agreed location. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Score A Kick regarding your use of the Service, superseding any prior agreements.
